AGENDIA ITEM 5 - A <br /> STAFF ORIGINATOR Marty Aslesoi <br /> DATE April 28, 1993 <br /> TOPIC LaMotte Park Use Issue <br /> We have received calls from residents in the LaMotte Park area <br /> concerning older youth playing in the park. The youth are on a <br /> regular basis hitting balls out of the park and .into neighboring <br /> residents yards, and off of any other object that happens to be out <br /> there. (ex: cars in driveways and in the street) <br /> I met with Mr. Horst Franke from 6941 LaMotte Dr. to try to resolve <br /> the issue. Mr. Franks feels that this problem can be resolved by <br /> putting signs up in the park restricting certain uses The issue <br /> was raised that there is a city park just one block away, <br /> Centerville Park, and there is opportunity for the youth to play <br /> there since this is a designated use for the park. <br /> Mr. Franke has purchased our comprehensive plan and has taken the <br /> time to review the document As it can be pointed out, M-6 or <br /> LaMotte Park, is small mini park and appears to be adequate to <br /> service this isolated neighborhood, and that the development of <br /> this park should not try to duplicate the facilities in the <br /> Centerville Park. <br /> Mr. Franke also 'points out .that the park has been identified for <br /> many possible uses as outlined in the comprehensive plan, all of <br /> which seem appropriate to him. The one amenity that has not been <br /> identified as a possible use is that of an informal ball field. <br /> Please see section 4 -37, design standards plate 6 of the comp plan <br /> for a description of standards for an informal play field. As this <br /> section, site specific circumstances will define the actual ,size of <br /> the play area,, and that safety concerns and proximity to <br /> residential properties need to be consideredon a per site 'basis. <br /> Mr. Franks feels that these are both concerns that limit or <br /> mitigate the playing of informal ball 'in LaMotte Park. <br /> I have contacted the League of Minnesota Cities and talked to one <br /> of their attorneys on limiting use of park areas. I also talked to <br /> our city attorney Bill Hawkins about the same. Both agreed that if <br /> the city, wishes to limit use in a park area, this can be done. The <br /> League attorney pointed out that we should have the legal authority <br /> to do this by having language in our park ordinance empowering <br />
