INFORMATION SERVICE Classification. # 4,(Fcl League of Minnesota Cities Municipality 183 University Ave E. p y St. Paul , MN 55101 Date Subject Jtme 17 AN ORDINANCE REGULATING THE USE OF PUBLIC PARKS IN THE j CITY OF BELLINGHAM, MINN& SOTA: PROVIDING FOR ENFORCE- MENT, AND PRESCRIBING PENAL- TIES FOR THE VIOLATION OF j ITS PROVISIONS The City Council of the City of Bellingham,Min- nesota,do ordain: , SECTION 1.01. Public parks or park when used herein shall mean real property owned by the City of Bellingham devoted to recreational use. 02. Defacing or Destroying Property Prohibited. No person shall deface,destroy,diminish or impair the value of public or private property located within any public park in the City of Bellingham.including buildings,structures,or trees,shrubs or vegetation located thereon or growing thereon.No person shall litter or cast or allow to remain rubbish or trash of any kind or nature in or about any public part in the City of Bellingham 03. Speed of Vehicles. No person shall drive or operate a motor vehicle at a speed in excess of ten (10) miles per hour in any recreational camping park. t 04.Park Hours.No person shall enter a public park between the hours of 2:00 a.rrL and 6:00 a.m-except to drive through once or set up overnight facilities in a quiet manner so as not to be a nuisance to other �\ overnight campers.After 2:00 a.m.all unnecessary noise shall cease.Campers shall limit activites so as not to distrub other campers in the park. 05.Overnight Parking Time Limit.Any person or persons using park facilities for overnight parking exceeding three days in succession is subject to writ- ten approval by the City Council and/or its designated agent for this purpose.The City Council shall set by resolution fees for overnight camping ex- ceeding three days. 06.Open Fire Prohibited.No person shall build a fire in any place in any park except in fireplaces or receptacles provided for the building of fires by the park management or in any area specifically posted with signs permitting the building of an open fire not in a fireplace or receptacle. 07. Washing of Vehicles Prohibited- No person shall wash any vehicle or camaer unit in a park area. 08. Use of Firearms and Explosives Prohibited. No person shall discharge firearms,air rifles,B.B. guns,sling shots,explosives or fireworks in or about any public park in the City of Bellingham. 09.Prohibited Conduct.No person shall engage in gambling,excessive use of alcoholic beverages,or abusive, boisterous, profane or indecent language, conduct or attire in or about any public park in the City of Bellingham. 10. Powers of Enforcement. In addition to any other persons or law enforcement officers invested with the powers of law enforcement and arrest of any person for the violation of any provisions of this or- dinance, all employees of the City of Bellingham whose duties are being discharged in a public park shall have the power to enforce the provtsons of this ordinance by the arrest of any person violating any of the provisions thereof and the costs of prooecutioa 11. Penalties for Violation.Any person violating any provision of this Ordinance or any regulation promulgated pursuant thereto shall be guilty of a misdemeanor and on conviction thereof shall be sub- ject to a fine not in excess of$100.00. 1 } SECTION 2.Effective Date.This ordinance shall be in full force and effect from and after the date of passage, approval and publication according to Passed by the City Council this loth day of June,1987.
