PLANNING & ZONING BOARD 3 March 10, 1993
Kathy Nordine then made a MOTION and was supported by Mr.
Gelbman to adopt the ordinance REPEALING PUBLIC AND SEMI-
PUBLIC USES FROM VARIOUS ZONING DISTRICTS WITHIN THE CITY.
All voted aye. Motion carried.
V. DISCUSSION ITEMS:
A. Proposed Ordinance Revisions
1. Wetland Delineation - Mr. Brixius explained that the
purpose of this proposed ordinance amendment is to
provide wetland delineation prior to preliminary plat
submittal. After some discussion Mr. Gelbman moved and
was supported by Mr. Mesich to set a public hearing for
April 14, 1993 on this item.
2. Lot Area - 100 year flood/ordinary high water (OHW)
(Country Lakes Estates Plat)
Mr. Brixius explained that there is a discrepancy between
City Ordinances relating to buildable land. The
Subdivision Ordinance appears to allow land within the
100 year flood as buildable land while the Zoning
Ordinance states that land below the 100 year flood shall
is not to be included in buildable area. This conflict
will be a problem in the review of the County Lakes
Estates Plat - Staff will be preparing some guidelines
with that plat for review and future ordinance revisions
and has suggested that this plat be processed as a PDO to
allow some flexibility. Mr. Schneider encouraged
flexibility in the review of this proposed plat as there
is an important gravity trunk sewer line that should go
through this area. It has been suggested that disclosure
be provided to alert buyers to the location of the OHW
and/or the 100 year flood line.
3. AN ORDINANCE REGULATING ADULT USE ACTIVITIES AND
BUSINESSES
The Planning & Zoning Board has been asked to set a
public hearing for the April meeting to provide review of
this proposed ordinance. Mr. Robinson made a motion
setting a public hearing for April 14, 1993 and was
supported by Kathy Nordine. All voted aye. Motion
carried.
4. Amendment to Ordinance - LOT PROVISIONS
Staff explained that the purpose of this Ordinance is to
provide for an improved street accepted by the city for
maintenance purposes prior to issuance of any building
permits. After some discussion Mr. Mesich made a motion
setting a public hearing for AN ORDINANCE AMENDING THE
ZONING ORDINANCE RELATING TO LOT PROVISIONS on April 14,
