AGENDA ITEM is <br /> January 21, 1993 <br /> Mr. Richard Carlson <br /> Carlson, Drops & Associates <br /> 7671 Old Central Avenue <br /> Fridley, Minnesota 55432 <br /> Dear Rick, <br /> This is a follow up letter to the letter that I sent to you on <br /> August 25, 1992 ; and the letter that you sent to the City of Lino <br /> Lakes on December 22 , 1992 . The message that needs to be <br /> understood is that the trail issue in the Woodridge Estates <br /> Development must be resolved. <br /> As was indicated in the August 25th letter, you as the developer in <br /> Woodridge Estates have a legal responsibility to provide an access <br /> through your residential area on the southeast end. The original <br /> agreement was to have this trail link between Lots 19 and 20, of <br /> Block 3 , and specifically on the north 10 feet of Lot 20, Block 3 <br /> as is legally described in the Easement Deed that the City now <br /> owns. <br /> To add to this, and in light of the timing that you chose to <br /> install this trail the property owner to the south was not only <br /> unaware of this trail segment, but was angry to discover the trail <br /> installed on his private property. This was a trespass situation. <br /> The home owner on the south side, Lot 19, Block 3 then took legal <br /> action to have this trail removed and contracted the work out to be <br /> done. The five feet of trail on the north side of Lot 20, Block 3 <br /> was evidently removed at this time. The city did not order this <br /> work to be done. { <br /> It should be pointed out that at the January 8, 1992 Park Board <br /> meeting both adjacent property owners presented their feelings on <br /> this whole issue. The Park Board agreed that it is the developers <br /> obligation to provide a trail access and alternatives. They also <br /> stated that they would prefer not to see a trail where it is <br /> legally described and would like to see an alternate route. Staff <br /> n was than asked to seek legal advice on this matter. <br /> I have been directed to inform you that if this trail segment is <br /> not completed by this spring (when this becomes a workable <br />
