4 <br /> MEMORANDUM <br /> TO: Planning and Zoning Board <br /> FROM: John Miller, City Planner <br /> DATE: September 3 , 1987 <br /> SUBJECT: Minor Subdivision for Helen Minor <br /> Application * 87-24 <br /> BACKGROUND: Helen Minor owns a 15 acre parcel on Ash <br /> Street , (County Road J) in the southern part of the city. <br /> Mrs. Minor' s daughter owns the adjacent five acres <br /> immediately east of the 15 acre parcel . The applicant <br /> wishes to sell five acres to her daughter, leaving each of <br /> them with ten acres . <br /> ZONING: The land is located in the city' s "R" rural <br /> district . The minimum lot size is ten acres with 330 feet <br /> of road frontage. <br /> COMPREHENSIVE PLAN: The land owned by Mrs. Minor and her <br /> daughter is shown as rural in the Lino Lakes comprehensive <br /> plan amendment. <br /> UTILITIES: There are currently no plans to extend utilities <br /> to this area. Ron Stahlberg, the city engineer has stated <br /> that it " . . . will be several years before sewer becomes <br /> available. " The land is outside the 1990 MUSA boundary. <br /> DEVELOPMENT PROBLEMS : The five acre parcel proposed to be <br /> split from the 15 acre property does not meet the minimum <br /> lot requirements of the "R" rural district . In addition <br /> (and as the attached aerial photo shows) much of the five <br /> acres to be split is unbuildable because of water and soil <br /> problems . "IN <br /> All of this really makes little difference. The applicant ' s <br /> daughter presently owns a home on her five acres and intends fit ` <br /> to combine the two parcels . By doing this she will have a <br /> conforming lot and will be able to pay homestead property <br /> tax on her full ten acres . <br /> PROFESSIONAL OPINION: Lino Lakes should approve the Minor <br /> subdivision requested by Mrs . Minor creating one ten and one <br /> five acre parcel . This action will turn a situation where <br /> there is one conforming and one non-conforming rural lot to <br /> a situation where there are two conforming lots . <br />
