CTFY COUNCIL <br /> AGENDA ITEM IF <br /> STAFF ORIGINATOR: Katie Larsen, City Planner <br /> MEETING DATE: June 28, 2021 <br /> TOPIC: Consider Resolution No. 21-61 Approving Site <br /> Improvement Performance Agreement for Otter Crossing <br /> VOTE REQUIRED: 3/5 <br /> BACKGROUND <br /> The applicant, Tyme Properties,LLC, submitted a land use application for the final plat of Otter <br /> Crossing. The plat creates a 1.46 acre parcel for the purpose of constructing a 7,800 sf <br /> commercial retail building. Per Section 1007.020 Site and Building Plan Review.. a Site <br /> Improvement Performance Agreement is required. <br /> (1) General. All site and building plans for multiple family, commercial, industrial or <br /> public/semi-public uses shall require review and approval by the Community Development <br /> Department. <br /> (5)Performance Standards. (d) The applicant shall, upon completion of site and building plan <br /> review, submit to the City an agreement that they will cause all improvements called for in the <br /> site and building plan review to be completed within the time specified by the City. Performance <br /> of such contracts shall be secured by the amount submitted at application or additional amount as <br /> may be required by the City Council. <br /> The attached Site improvement Performance Agreement addresses the site improvements for the <br /> building and provides for submittal of all required fees and securities. <br /> RECOMMENDATION <br /> Staff recommends approval of Resolution No. 21-61. <br /> ATTACHMENTS <br /> 1.
