Can ramps be cost effectively constructed to reflect appropriate design "standards" for use of <br /> materials that present the lowest potential ongoing maintenance cost? Have designs <br /> incorporated the use of impact absorption material around the perimeter fall areas of ramps, <br /> etc.? <br /> 8. Does the need for the facility outweigh the potential for injuries and liability claims and lawsuits <br /> that may emanate from the facility? Does the current legal climate for parks and recreation <br /> liability favor operation of such a facility <br /> 9. Can establishment of such a facility sustain a challenge for accessibility for use by disabled <br /> persons under the Americans with Disabilities Act of 1990? <br /> 10. Have alternatives to the public entitys operation of the facility been fully explored? For example: <br /> a) is there an formally organized group or private individual that could more effectively <br /> operate the facility on private property? <br /> b) Could such a facility be operated appropriately if it were placed on public property, but <br /> operated by a formally organized group or private individual that has obtained <br /> appropriate insurance coverage and established a proper operations agreement with the <br /> community? <br /> ammo I L <br /> As can be noted from this advisory information, potential liability issues emanating from <br /> skateboarding activities in public entities tend to be more complex than they may appear <br /> on the surface.
