COUNCIL MINUTES MARCH 9, 1998 <br /> for payment No. 7 (final) in the amount of$23,328.52, including change orders 3 and 4. This <br /> project, completed in the fall of 1996, included construction of trunk sanitary sewer and <br /> watermain from Cedar Street to Main Street, providing utility service to the Clearwater Creek <br /> Economic Development area. The final contract amount is summarized as follows: <br /> Contract Amount to date $773,509.59 <br /> Change Order No. 3 64,129.95 <br /> Change Order No. 4 13,328.52 <br /> Final Contract Amount $850,968.06 <br /> Mr. Ahrens explained that Change Order No. 3 reflects the actual quantities installed by the <br /> contractor compared to the estimated amounts by the Engineer, Change Order No. 4 includes <br /> work to restore the fence at the Acton construction site and repair of the driveway, sign and <br /> restoration of drainage at the Otter Lake Veterinary Clinic, and Change Orders No. 1 and 2 were <br /> previously approved by Staff and include work to restore road access to Adgraphics and <br /> Northern Wholesale, and completion of various items not included in the original contract. <br /> Mayor Sullivan asked if the engineer involved in the bidding process would not have been aware <br /> of the need to route utilities under the existing roadway. Mr. Ahrens explained that at the time of <br /> the bid NSP's requirements with regard to affected power poles were not known. Mayor <br /> Sullivan pointed out that this particular pole is a heavy transmission system structure. <br /> Council Member Bergeson moved to adopt Resolution No. 98 - 34, as presented. Council <br /> Member Lyden seconded the motion. Motion carried unanimously. <br /> Resolution No. 98 - 34 can be found at the end of these minutes. <br /> Consideration of Resolution No. 98 - 35, Approve Relocation Agreement with Northern <br /> States Power Company, Otter Lake Realignment Project- Mr. Ahrens explained that the <br /> planned realignment of Otter Lake Road impacts a guy wire supporting a Northern States Power <br /> pole. This guy wire is located on private property, and not within the County right-of-way. <br /> Therefore, the City is responsible for the cost of relocating the guy wire. This cost is estimated <br /> to be $21,000 and would be assessed to benefiting property owners. Pursuant to the proposed <br /> relocation agreement,NSP is requesting payment of 80%of that amount, or$16,800 to be paid <br /> in advance. City Attorney Hawkins has reviewed the proposed agreement, and finds it to be in <br /> order. <br /> Mr. Ahrens pointed out that the original road realignment would have necessitated relocation of <br /> the entire pole, at a cost to the City in excess of$140,000. Therefore,the realignment was <br /> revised with County approval to reduce the impact to the guy wire only. Avoiding impact <br /> completely would have required additional right-of-way from the property owner, which would <br /> have created a narrow strip of undevelopable land between the power line easement and the road <br /> right-of-way. Considering the above, Staff recommended relocation of the guy wire. <br /> 12 <br />
