COUNCIL MINUTES NOVEMBER 25, 1996 <br /> Ms. Wyland explained that according to the Zoning Ordinance,transmission towers and other <br /> similar towers up to 55 feet in height are permitted uses. Towers between 55 feet and 200 feet <br /> are permitted with a conditional use permit. Additionally, any time there is a change or alteration <br /> to an existing conditional use permit, an amendment is required. <br /> The property in question is zoned Rural and indicated as such on the City's land use map. The <br /> subject parcel of property contains approximately 120 acres and is owned by WCCO Inc. <br /> Teleport Minnesota has a lease agreement with WCCO. <br /> The Planning and Zoning Board recommended approval of this request at a public hearing on <br /> Wednesday,November 13, with the following conditions: <br /> 1. Proper building permits shall be obtained prior to construction. <br /> 2. Criteria outlined in Resolution No. 10 - 91 shall be made a part of this permit. <br /> (Resolution 10 - 91 was adopted by the City in response to a previous amended <br /> conditional use permit for this property) including enhancement of the landscaping plan <br /> to further screen the facility from adjoining properties. This plan shall be subject to <br /> review and approval by the City Forester. <br /> Staff recommended approval of the amended conditional use permit including the conditions <br /> listed above. <br /> Council Member Bergeson asked if a 4/5ths vote is required for this action. Ms. Wyland <br /> responded no. <br /> Council Member Neal moved to approve the amended conditional use permit for Teleport <br /> Minnesota, with the conditions presented. Council Member Bergeson seconded the motion. <br /> Motion carried unanimously. <br /> CITY ENGINEER'S REPORT,DAVID AHRENS <br /> Consideration of Resolution No. 96- 149, Ordering Improvement and Preparation of Plans <br /> and Specifications for the I-35W/TH 49 Commercial Development Area Trunk Utilities - <br /> Mr. Ahrens explained this item will be addressed of the special Council meeting on Wednesday, <br /> November 27, 1996 or Monday, December 2, 1996. <br /> Consideration of Resolution No. 96 - 150, Declaring Intent to Bond, I-35W/TH 49 <br /> Commercial Development Area Trunk Utilities - Mr. Ahrens reiterated these items will be <br /> acted upon at the special meeting on Wednesday,November 27 or Monday, December 2, 1996. <br /> Consideration of Resolution No. 96 - 151, Receiving Report and Calling Hearing on the <br /> Otter Lake Service Road Street Improvements -Mr. Ahrens used the overhead projector and <br /> showed the location of the Otter Lake Service Road street and utility improvements. He noted <br /> that the Clearwater Creek Development Area continues to receive interest from business owners <br /> 9 <br />
