I subsequently had the Park Maintenance Department staff <br /> remove the track. I discussed the situation with Mrs. Terri Scheele regarding my concerns with <br /> the existence of residents constructing a BMX Track on park property. <br /> Mrs. Scheele is planning on requesting the City to allow the neighborhood residents to create and <br /> maintain a BMX Track on park property. <br /> Certainly my most significant concern deals with the liability issue. Attached is a response from <br /> Bill Hawkins. Mr. Hawkins claims that it is possible to lease a portion of the park for this <br /> purpose. <br /> If the City accepted the offer to lease some land to Mrs. Scheele she would be obligated to obtain <br /> general liability insurance coverage and name the City as additional insured. Furthermore, the <br /> lease would require the entity to indemnify the City for any injuries that may take place on the <br /> property. The current tort limits are $300,000 per claim and $750,000 per occurrence. <br /> As you are aware the Quail Ridge Park was master planned this past winter. In prioritizing the <br /> overall park system needs, I do not anticipate development of this park for quite some time, <br /> unless a significant amount of financial assets are secured (bond referendum). <br /> Att. <br /> sw/parkbrd/Request to Lease Portion of Quail Ridge Park to Residents for BMX Track <br />
