I subsequently had the Park Maintenance Department staff
remove the track. I discussed the situation with Mrs. Terri Scheele regarding my concerns with
the existence of residents constructing a BMX Track on park property.
Mrs. Scheele is planning on requesting the City to allow the neighborhood residents to create and
maintain a BMX Track on park property.
Certainly my most significant concern deals with the liability issue. Attached is a response from
Bill Hawkins. Mr. Hawkins claims that it is possible to lease a portion of the park for this
purpose.
If the City accepted the offer to lease some land to Mrs. Scheele she would be obligated to obtain
general liability insurance coverage and name the City as additional insured. Furthermore, the
lease would require the entity to indemnify the City for any injuries that may take place on the
property. The current tort limits are $300,000 per claim and $750,000 per occurrence.
As you are aware the Quail Ridge Park was master planned this past winter. In prioritizing the
overall park system needs, I do not anticipate development of this park for quite some time,
unless a significant amount of financial assets are secured (bond referendum).
Att.
sw/parkbrd/Request to Lease Portion of Quail Ridge Park to Residents for BMX Track
