COUNCIL MINUTES APRIL 12, 1999 Council Member Dahl suggested it states in the documents that the City can improve the property. Mayor Sullivan amended the motion to include that the by-laws state the City can assess the property owners. Council Member Bergeson asked if that means an individual is trespassing if he goes into the green space and does not live there. Mayor Sullivan stated that is correct. Voting on the motion, motion failed with Council Member Bergeson, Dahl, and Lyden voting no. Council Member Lyden moved to approve the Preliminary Develop t Pn fore PDO based on the following conditions: 1. Eliminate Greenway E as open space and useKa typical d" age easement over the wetland. The wetland will then be within platted"illo�v�th an easement over it. 2. A buffer detail for the strip of land bet?yeen Otter Lake Road and Lot 4 Block 12 should be provided. 3. Exact trail alignments throughm;:tv pment will be established with Parks staff. 5. The de,y_'eloper will need approvals from Anoka County for the new road access to Otter Lake Drive. The developer also will need to meet any County requirement for additional ROW on Otter Lake Road(CR 81). 6. A tree preservation plan and street tree landscaping plan must be submitted for review by the City Environmental Specialist. Noise abatement to address freeway noise should be considered in this plan. 7. All permits required by the Rice Creek Watershed District shall be obtained prior to an site grading. 8. Utility, grading, and drainage plans must obtain approval from the City Engineer and Rice Creek Watershed District. 11
