COUNCIL MINUTES APRIL 12, 1999 <br /> Council Member Dahl suggested it states in the documents that the City can improve the <br /> property. <br /> Mayor Sullivan amended the motion to include that the by-laws state the City can assess the <br /> property owners. <br /> Council Member Bergeson asked if that means an individual is trespassing if he goes into the <br /> green space and does not live there. <br /> Mayor Sullivan stated that is correct. <br /> Voting on the motion, motion failed with Council Member Bergeson, Dahl, and Lyden voting <br /> no. <br /> Council Member Lyden moved to approve the Preliminary Develop t Pn fore PDO based <br /> on the following conditions: <br /> 1. Eliminate Greenway E as open space and useKa typical d" age easement over the <br /> wetland. The wetland will then be within platted"illo�v�th an easement over it. <br /> 2. A buffer detail for the strip of land bet?yeen Otter Lake Road and Lot 4 Block 12 <br /> should be provided. <br /> 3. The developer will�pa*e the trails and'wth the 8.4 acres,the park dedication <br /> requirement would e <br /> 4. Developer ve tr ��9alignments near Lots 1 & 2 Block 1 and Lots 1 & Block 5 if <br /> possibl G to etter connection with other trail segments. Exact trail alignments <br /> throughm;:tv pment will be established with Parks staff. <br /> 5. The de,y_'eloper will need approvals from Anoka County for the new road access to <br /> Otter Lake Drive. The developer also will need to meet any County requirement for <br /> additional ROW on Otter Lake Road(CR 81). <br /> 6. A tree preservation plan and street tree landscaping plan must be submitted for review <br /> by the City Environmental Specialist. Noise abatement to address freeway noise should <br /> be considered in this plan. <br /> 7. All permits required by the Rice Creek Watershed District shall be obtained prior to an <br /> site grading. <br /> 8. Utility, grading, and drainage plans must obtain approval from the City Engineer and <br /> Rice Creek Watershed District. <br /> 11 <br />
