COUNCIL MINUTES NOVEMBER 23, 1998
Mayor Sullivan recessed the meeting for five (5)minutes at 8:17 p.m. `--
Mayor Sullivan reconvened the meeting at 8:30 p.m.
Zoning Text Amendment Pertaining to Non-Conforming Structures, Mary Kay Wyland
(4/5th Vote)-Ms. Wyland stated the Planning and Zoning Board suggested the following text
amendment as a result of the recent variance request from a property owner on Bald Eagle
Boulevard. This amendment would allow additions to non-conforming structures provided there
is no increase in the number of units or an expansion in the degree of non-conformity. The
Zoning Ordinance, Section 3, Subd. 2 B.9 currently reads as follows:
Alterations may be made to a structure containing non-conforming residential units when
they will improve the livability thereof, provided they will not increase the number of
dwelling units or expand size of existing building or structure.
The proposed language is as follows:
Alterations may be made to a structure containing non-conforming residential units when
they will improve the livability thereof, provided they will not increase the number of
units or expand the size or degree of non-conformity.
Council Member Neal asked if this was the farm next to Andy Cardinal. Ms. Wyland stated the
property that precipitated the change is on Bald Eagle Boulevard.
Council Member Bergeson stated the Council in the past has done with a variance what this
amendment suggests. The justification for prior variances is it did not increase the size of the
non-conformity. This change puts it into the code.
Council Member Neal asked how the Planning and Zoning Board voted. Ms. Wyland stated the
Planning and Zoning Board vote was 7-0 in favor of the amendment.
Council Member Lyden moved to approve the First Reading of the Ordinance Amendment, as
presented. Council Member Neal seconded the motion. Motion carried unanimously.
Comprehensive Land Use Plan,Brian Wessel-Mr. Wessel stated that communities within the
seven(7) county metro area have been mandated, by State Legislation,to submit their updated
comprehensive plan to the Metropolitan Council by year end. The Comprehensive Plan Task
Force approved the Lino Lakes Comprehensive Plan on a 12-0 vote, the Lino Lakes Planning and
Zoning Board approved the plan on a 6-1 vote. Staff would recommend submittal to the
Metropolitan Council of the Draft Comprehensive Land Use Plan for the City of Lino Lakes.
This plan will then be reviewed by Met Council staff. That staff review may include
recommendation for approval or suggest changes or revisions to the plan. Upon completion of
the Met Council review, the City Council will be asked to adopt a final draft of the Plan. This
will most likely occur in the first quarter of 1999.
14
