The aforementioned obstacles that have recently appeared do not
.-.. include problems that will now be encountered because of the
wetland condemnation by the City of Lino Lakes. Prior to the
condemnation, we could have rearranged the wetland within the
allowances of mitigation and received a nationwide permit to allow
some fill. Now we cannot touch it other than for excavation. In
addition, because it has been condemned for easement purposes only,
the taxes must continue to be paid by the existing owners and we
cannot meet the necessary setbacks from it to use the area between
the easement and Lake Drive. This does not include the land we
cannot use on the south side of the easement which we pay for at
the rate of $10,000 an acre - a premium rate given the recession we
are now facing.
Many of the issues noted above were not addressed when we first
presented our conceptual plat to the City Council. We would
propose that we submit the preliminary plat as approved with the
road being relocated in lieu of park dedication (trails and some
land will still be provided as shown to the Park Board). The other
issues which appear to be in a state of confusion will then be
resolved by the City Council at the public hearing and some
direction can then be taken for the final plat. This will expedite
the process. The alternative is to lose another month in
attempting to resolve the newly arising issues prior to appearing
before the City Council in which case the issues will still be
altered in the public hearing process anyway.
Hokanson Development, Inc.
Kirk Corson
KC/klu
Enclosures: Original concept plan
Plan shown to Park Board
