Upon termination of this Agreement, all property of the <br /> program shall be sold and any surplus money and property <br /> of the program remaining after payment of all liabilities <br /> shall be returned to the parties in proportion to each <br /> party's total contribution to the program over the last <br /> three (3) years. Property contributed to the program for <br /> use but not owned by it, shall not be sold, but rather <br /> shall be returned to the party that contributed it. A <br /> party's total contribution shall include. monies <br /> contributed, and fair market value of property and goods <br /> contributed. <br /> ARTICLE V <br /> DISPUTE RESOLUTION <br /> Whenever the City of Lino Lakes or School District <br /> believes there is a misinterpretation or a violation of <br /> the specific terms and conditions of this Agreement, they <br /> may initiate the dispute resolution process by submitting <br /> a written statement outlining the dispute or disagreement <br /> to a Resolution Committee. <br /> The Committee shall be composed of the Lino Lakes City <br /> Administrator and one other person the Administrator <br /> shall select, and the Superintendent of Schools and one <br /> other person the Superintendent shall select. The <br /> Committee shall have received the written statement when <br /> a copy is delivered to the City Administrator and <br /> Superintendent. The City Administrator shall call a <br /> meeting of the Committee within ten (10) days of having <br /> received the written statement. Within ten (10) days of <br /> the Committee meeting, the Committee shall issue its <br /> written response to the School Board and City Council of <br /> Lino Lakes. <br /> If the Resolution Committee cannot mutually agree as to <br /> the appropriate interpretation or application of the <br /> specific terms of this agreement, the dispute shall be <br /> forwarded to the Anoka County Mediation Service or a <br /> similarly appropriate mediation service. If the members <br /> cannot mutually agree, through the mediation process, <br /> within 60 days following the Resolution Committee' s <br /> written response, then the City or School District may <br /> initiate the submission of the issue to the American <br /> Arbitration Association for a mutually binding decision. <br /> The costs of the arbitration process shall be equally <br /> shared by the City and School District. <br />
