Tree protection fence appears to encroach on protected root zone areas <br /> on trees on all four lots. Green ash (Fraxinus pennsylvanica) and Siberian elm (Ulmus pumila) <br /> appear on the list of trees intended to be saved. These trees should be <br /> removed if they are in the vicinity of other planned removals. Mitigation <br /> trees for removals of these species will not be required. <br /> 5. Red maple and sugar maple should be removed from the suggested trees <br /> to replant with list on the Tree Mitigation Plan. <br /> 6. Stormwater basins are not part of Basic Use Areas. Trees that are planned to <br /> be removed in these areas must be mitigated for at applicable rates. <br /> The tree removal and mitigation plan will be updated in the final plans to <br /> incorporate these comments and any others resulting from the review process. <br /> Items 3-6 have not been addressed at this time. <br /> 7. Prohibit motorized boats on Amelia Lake. <br /> Staff comment: Pursuing this would require interaction with the MN DNR as <br /> the agency responsible for Water Surface Use Restrictions. The process <br /> would involve adopting surface use restrictions for the lake into ordinance, <br /> which would require a hearing and approval from the DNR. It would also <br /> require working with homeowners who currently have docks and boats on <br /> Amelia Lake. <br /> Motorized boat prohibition was determined to be a separate issue not <br /> applicable to this preliminary plat. <br /> •Page 2 <br />
