Surfacewater management systems including a Lake and Ponds ("Lake and <br />Ponds") have been located on property owned by the Neighborhood Association and the <br />Townhome Association and legally described as: <br /> <br /> Outlots E, G and Outlot J, Watermark, and Outlot D, Watermark 4th Addition, Anoka <br />County, Minnesota (the "Outlots"). <br /> <br />B. The Lake and Ponds are encumbered by a public Drainage and Utility easement in <br />favor of the City. <br /> <br />C. The City has required that the surfacewater in the Lake and Ponds be used to <br />provide irrigation water to the common elements within the Watermark residential community (the <br />"Common Elements") as identified on Exhibit A attached hereto and incorporated herein, <br />including the townhome area, I-35E berm, and boulevard landscaping. <br /> <br />D. A Stormwater Re-Use Distribution System (the "Distribution System"), including <br />without limitation a Stormwater Re-Use Pump and RPZ backflow preventer assembly (the "RPZ
