8 <br /> <br />Development Agreement and Planned Unit Development Agreement <br /> <br />The City will also require our standard Development Agreement specific to each phase of <br />development. This agreement further details required improvements and securities. The City <br />Engineer has drafted this Agreement and it shall be approved by the City Council. <br /> <br />City Park Operations and Maintenance and Stormwater Re-Use Agreement and Stormwater <br />Re-Use Agreement <br /> <br />The City is required, through MPCA permitting, to reduce nutrient loading within the Peltier <br />Lake watershed. In addition, the City has goals to reduce the use of municipal water supply for <br />irrigation purposes. Part of the nutrient loading reduction will be completed through four re- <br />use systems within the Watermark Development. The re-use systems are maintained through <br />the following agreements: <br /> <br />City Park O & M and Stormwater Re-use Agreement <br /> <br />The City owned park will be irrigated with water from a Stormwater Re-use system. The Re- <br />use system will also supply water to irrigate the boulevard of Watermark Way. The Re-use <br />system and boulevard irrigation system will be owned and maintained by the Watermark <br />Neighborhood Association. Lake 20 is owned and maintained by the Neighborhood <br />Association. The agreement provides the City rights to the re-use system, and the use of <br />surfacewater from Lake 20. The agreement also addresses use of the City’s municipal water <br />supply in the event the lake levels drop more than 4 ft. <br /> <br />Stormwater Re-use Agreement <br /> <br />The Stormwater Re-use Agreement is for the other 3 re-use pump systems that will irrigate <br />townhome area, I-35E berm, and 21st Ave boulevard landscaping. These systems will be <br />owned and maintained by the Watermark Neighborhood Association and the Watermark <br />Townhome Association. Similar to the park re-use agreement the agreement addresses use of <br />the City’s municipal water supply in the event the lake levels drop more than 4 ft. <br /> <br />Homeowner’s Association (HOA) <br /> <br />The City Attorney reviewed and approved the submitted HOA documents. <br /> <br />Title Commitment <br /> <br />The City Attorney reviewed the title commitment and final plat. The Attorney recommends <br />requiring Lennar to update the title to have an effective date consistent with the release and <br />recording of the plat. <br /> <br />Stormwater Maintenance Agreement <br /> <br />The stormwater facilities will be covered under the City’s Programmatic Stormwater <br />Management Agreement after they have been installed and accepted by the City. <br />
