<br />5 <br /> <br />The plight of the landowner is not due to circumstances unique to the property. The <br />property is not unique when compared to other similar sized rural properties with similar <br />uses and large accessory structures. The landowner is allowed to operate a commercial <br />stable in accordance to Resolution No. 21-67. The landowner purchased the property <br />under the false assumption they could have an unlimited number of animal units. <br /> <br />5. The variance shall not alter the essential character of the locality. <br /> <br />The variance will alter the essential character of the locality which is a single family <br />home, riding stable and arena in a rural residential neighborhood. The number of <br />allowed animal units has already been doubled from 12.5 to 25.0 with the approved <br />conditional use permit. The magnitude of quadrupling the number of animal units from <br />12.5 to 50 alters the essential character of the locality. <br /> <br />6. A variance shall not be granted for any use that is not allowed under the ordinance for <br />property in the zoning district where the subject site is located. <br /> <br />The variance will not be granted for any use that is not allowed under the ordinance for <br />property in the zoning district. The property is zoned R, Rural and commercial stable is <br />allowed with an approved conditional use permit. <br /> <br />7.
