<br />2 <br /> <br />FINDINGS OF FACT <br /> <br />1. The final plat substantially conforms to the approved preliminary plat subject to the <br />conditions listed below. <br />2. The City Attorney has reviewed the status of title/property ownership related to the <br />final plat prior to release of mylars. <br />3. A Development Agreement has been drafted and shall be executed. <br />4. Conditions attached to approval of the preliminary plat have been fulfilled or <br />secured by the Development Agreement. <br />5. All fees, charges and escrow related to the preliminary or final plat have been paid <br />in full. <br /> <br />BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby <br />approves Lyngblomsten at Lino Lakes Addition PUD Final Plan/Final Plat subject to the <br />following conditions: <br /> <br />1. The developer shall maintain a 25 ft wetland buffer and signage as depicted on <br />Sheet C0.00, Wetland Buffer Map. <br />a. The wetland buffer and upland habitat will consist of vegetated land, <br />consisting primarily of plant species native to this region, that is not <br />cultivated, cropped, pastured, mowed, fertilized, used as a site for <br />depositing snow removed from roads, driveways or parking lots, subject to <br />the placement of mulch or yard waste, or otherwise disturbed, except for <br />periodic cutting or burning that promotes the health of the wetland buffer <br />or upland habitat, actions to address disease or invasive species, or other <br />actions to maintain or improve wetland buffer or upland habitat quality, <br />each as approved in writing by City staff. <br />b. The wetland buffer shall be maintained in accordance with standard <br />vegetation management practices. <br />2. The developer is responsible for the installation, establishment and future <br />maintenance of all landscaping, vegetation, fences and signage consistent with the <br />approved PUD Final Plan. <br />3. Future development of Lot 2, Block 2 and Outlot C, Lyngblomsten at Lino Lakes <br />Addition shall be reviewed by the Planning & Zoning Board for recommendation <br />to the Council. <br />4. Future development of Outlot C, Lyngblomsten at Lino Lakes Addition shall <br />require final plat and full site plan review. <br />5. Future development of Lot 2, Block 2, Lot 3, Block 2 and Outlot C, <br />Lyngblomsten at Lino Lakes Addition shall be consistent with the PUD Final <br />Plan, 49/J Master Plan, Lyngblomsten Design Standards and City Ordinances. <br />6. After site grading and street construction, City staff, developer and the property <br />owners of 251 Woodridge Lane and 253 Woodridge Lane shall work together to <br />determine the best location for a screening fence between their property and the <br />public road. <br />7. The following easements detail the scope, construction, and maintenance <br />responsibilities for the private roads and public trails: <br />a. Permanent Right of Way Easement
