CITY COUNCIL WORK SESSION <br />DRAFT <br /> 2 <br />reviewed the history of use at the property. Basically the council is being asked to 45 <br />consider a conditional use permit and a variance. She noted that the Planning and Zoning 46 <br />board approved the CUP request and voted to deny the variance request. City Attorney 47 <br />Squires noted the CUP history of the property; there were ordinances changes along the 48 <br />way, the use became nonconforming and a change in use lost their grandfather rights, and 49 <br />now they are applying for a new CUP. 50 <br /> 51 <br />Councilmember Lyden remarked that the issue with the use began when the property was 52 <br />inspected after a complaint was received; he asked how many complaints were received? 53 <br />Planner Larsen said complaints are anonymous but she can report that there was one 54 <br />complaint initially and that some people spoke at the Planning and Zoning Board public 55 <br />hearing as well. Councilmember Lyden noted that he has done some research on “animal 56 <br />units” and has seen that the City of Ramsey has no limit on properties over 20 acres. For 57 <br />him, it’s a question of reasonable and fair use of one’s property. 58 <br /> 59 <br />Councilmember Ruhland asked if the applicant’s attorney is comfortable with the finding 60 <br />that the 1960’s CUP is no longer valid and City Attorney Square said not but that he is 61 <br />comfortable with his finding. Councilmember Ruhland asked if it is an assumption that 62 <br />there were no animals present when the property began being used for BMX; Mr. Squire 63 <br />said there are facts and he is comfortable in the finding. Councilmember Ruhland noted 64 <br />that there was some question about the waste management plan since the applicant didn’t 65 <br />feel that staff was able to give any direction in that area. Councilmember Ruhland asked 66 <br />about how the acreage was determined; did staff’s determination include such things as 67 <br />wetlands and easements?
