General Provisions_V1 <br /> <br />3-71 <br />§1007.046 PRIVATE DRIVES. <br /> <br />In conjunction with the review of two family or multiple family residential plats, the City Council <br />may approve private drives that serve more than one dwelling unit, provided that all of the <br />following conditions are met. <br /> <br />(1) The City Council finds that any such private drive is deemed necessary to allow reasonable <br />development of a particular site, and that such private drive is not allowed or intended to be a <br />substitute for the public street system. <br /> <br />(2) Any such private drive shall not exceed 300 feet in length unless it forms a continuous <br />connection or loops back to a public street. Any such private drive over 150 feet in length that does <br />not form a continuous connection or loop back to a public street shall provide a turn-around at or <br />near its terminus, in accordance with City specifications. <br /> <br />(3) Any such private drive shall gain access only from streets classified as “local” or “minor <br />collector” by the City’s Comprehensive Plan. <br /> <br />(4) Any such private drive shall gain access from the public street via a 20-foot long concrete <br />driveway apron with cross gutter, or other material as may be approved by the City Council. The <br />remaining portion of the private drive shall be designed, constructed, and surfaced in such a <br />manner, as approved by the City Council, to distinguish it from a public street. <br /> <br />(5) Any such private drive shall be a minimum of 26 feet wide. No parking shall be allowed <br />on the private drive, however, guest parking spaces may be required to be installed adjacent to the <br />private drive, as determined by the City Council. <br /> <br />(6) Individual unit driveways that gain access from any such private drive shall be a minimum <br />of 22 feet in length. <br /> <br />(7) Approval of any such private drive shall not be granted if the private drive is to be placed <br />within a separate lot. <br /> <br />(8) A decorative sign stating “Private Drive” shall be located near each entrance to any such <br />private drive. Such sign shall also provide the range of addresses served by the private drive. Such <br />sign shall not exceed eight square feet in area or five feet in height, pursuant to Section 1010.007. <br /> <br />(9) Signage stating “No Parking – Fire Lane” shall be placed along the private drive in <br />locations as approved by the City Fire Inspector. <br /> <br />(10) A homeowners association agreement or other instrument acceptable to the City <br />shall be required to ensure that any such private drive remains “private” in perpetuity. Such <br />instrument shall require mandatory participation of all homeowners that have access via the private <br />drive, shall include the requirement for creation of a fund to address maintenance, snow removal,
