3. General Provisions_V1 <br /> <br />3-64 <br />(d) On-site parking shall only occur in areas designed and constructed for parking in <br />accordance with this Ordinance. <br /> <br />(e) The applicant and City enter into a development agreement, to be recorded against <br />the subject property, which includes a clause requiring the owner to install the additional parking <br />stalls, upon a finding of the Community Development Director that such additional parking stalls <br />are necessary to accommodate the use. <br /> <br />(f) A change of use will necessitate compliance with the applicable Zoning Ordinance <br />standard for parking. <br /> <br />(8)(7) Joint Parking Facilities. Off-street parking facilities for a combination of mixed <br />buildings, structures, or uses may be provided collectively in any non-residential zoning district in <br />which separate parking facilities for each separate building, structure or use would be required, <br />provided that the total number of spaces provided shall equal the sum of the separate requirements <br />of each use during any peak parking periods. Shared curb cuts and access drives shall be <br />encouraged for lots accessing collector and arterial streets. Where shared access and parking are <br />utilized, easements shall be placed on the shared area and recorded with the properties and a <br />maintenance agreement required. <br /> <br />(9)(8) Control of Off-Site Parking Facilities. When required, accessory off-street parking <br />facilities are provided elsewhere than on the lot in which the principal use served is located, they <br />shall be in the same ownership or control either by deed or long term lease, as the property <br />occupied by such principal use, and the owner of the principal use shall file a recordable document <br />with the City requiring the owner and his or her heirs and assigns to maintain the required number <br />of off-street spaces during the existence of said principal use. <br /> <br />(10)(9) Traffic Control. <br /> <br />(a) The traffic generated by any use shall be channelized and controlled in a manner that <br />it will minimize: <br /> <br />1. Congestion on the public streets. <br /> <br />2. Traffic hazards. <br /> <br />3. Excessive traffic through residential areas, particularly truck traffic. <br /> <br />(b) Internal traffic shall be regulated as to ensure its safe and orderly flow. Traffic into <br />and out of business and industrial sites and traffic from residential lots with direct access to a <br />collector street or arterial street shall in all cases be forward moving with no backing into streets. <br />Direct residential lot access to collector and arterial streets shall be prohibited wherever alternative <br />local street access is available. <br />
