CITY COUNCIL <br />AGENDA ITEM 6A <br />STAFF ORIGINATOR: Andy Nelson, Environmental Coordinator <br />MEETING DATE: November 8, 2021 <br />TOPIC: Consideration of Resolution No. 21-130, Authorizing Execution of <br />Joint Powers Agreement with Anoka County to Implement the <br />City Wellhead Protection Plan <br />VOTE REQUIRED: 3/5 <br />BACKGROUND <br />The Minnesota Department of Health and Minnesota Rule 4720.5130 requires each public water <br />supplier in the state to prepare and update a Wellhead Protection Plan to prevent the <br />contamination of ground water serving municipal wells. <br />In 1997, several Anoka County cities entered into a Joint Powers Agreement (JPA) for the <br />purpose of developing the required Wellhead Protection Plans, establishing the Anoka County <br />Municipal Wellhead Group, and establishing the County as fiscal agent for the Group. <br />In 2010, the group entered into an Implementation JPA for the purpose of collaborating to <br />implement the common elements of the Wellhead Protection Plans in an efficient and cost- <br />effective manner. <br />In 2014, the Implementation JPA included an addendum to allow additional cities to join the <br />group without requiring each member city to return to their Councils for new resolutions. <br />The amended and restated Implementation Joint Powers Agreement for 2021 includes an updated <br />list of participating cities, clarifies the process for a city joining the group, and cleans up the <br />language on minor points. Also, section 5.5 declares that a city that desires to refrain from a <br />project but cannot be removed from the project may not refrain from participating if a majority <br />of the group affirms the project. Staff has evaluated this item and deemed that, due to the types <br />of projects that may be impacted, it is not a concern at this time. <br />RECOMMENDATION <br />Staff recommends approval of Resolution No. 21-130, entering into a Joint Powers Agreement <br />with Anoka County and Anoka County Cities to Implement the City Wellhead Protection Plan.
