1 <br /> <br />CITY COUNCIL <br />AGENDA ITEM 1E <br /> <br /> <br />STAFF ORIGINATOR: Katie Larsen, City Planner <br /> <br />MEETING DATE: November 8, 2021 <br /> <br />TOPIC: Consider Resolution No. 21-128 Extending the Recording <br />Date for the PUD Final Plan/Final Plat of Natures Refuge <br /> <br />VOTE REQUIRED: 3/5 <br /> <br />INTRODUCTION <br /> <br />The developer, Preferred Builders, Inc., is requesting an additional 90 day extension for <br />recording the PUD Final Plan/Final Plat of Natures Refuge. <br /> <br />BACKGROUND <br /> <br />On September 14, 2020, the City Council passed Resolution No. 20-81 approving the PUD <br />Final Plan/Final Plat for Natures Refuge. Per Subdivision Ordinance Section 1001.059(3), the <br />developer shall record the plat within 90 days after the date of approval, otherwise the approval <br />of the final plat shall be considered void, unless the developer requests and receives an <br />extension from the City Council. On December 14, 2020, the City Council passed Resolution <br />No. 20-161 extending the recording date to March 13, 2021. On March 22, 2021, Council <br />approved Resolution No. 21-24 extending the recording date another 90 days to June 11, 2021. <br />On June 14, 2021, the City Council passed Resolution No. 21-54 extending the recording date <br />another 90 days to September 12, 2021. On August 23, 2021, the City Council passed <br />Resolution No. 21-88 extending the recording date to December 11, 2021. <br /> <br />On August 25, 2021, Preferred Properties entered into a purchase agreement with Manley <br />Family Trust for the acquisition of the Natures Refuge Development. M/I Homes then <br />expressed interest in the development and are expecting to close on the property on or before <br />January 22, 2022. They are asking for another 90 day extension to complete their due <br />diligence, finalize their purchase agreement and record the final plat. <br /> <br />An additional 90 day extension would make the new recording deadline March 11, 2022. <br /> <br />RECOMMENDATION <br /> <br />Staff recommends approval of Resolution No. 21-128 granting an additional 90 day extension <br />to March 11, 2022 for recording the final plat and related documents for Natures Refuge. <br /> <br />ATTACHMENTS <br /> <br />1.
