CITY COUNCIL <br />AGENDA ITEM 3A <br /> <br /> <br />STAFF ORIGINATOR: Jeff Karlson, City Administrator <br /> <br />MEETING DATE: April 27, 2020 <br /> <br />TOPIC: Cable Commission Joint Powers Agreement Updates <br /> <br />VOTE REQUIRED: 3/5 <br /> <br /> <br />INTRODUCTION <br /> <br />The City Council is being asked to adopt Resolution No. 20-38, Amending Joint Cooperative <br />Agreement for the North Metro Telecommunications Commission. <br /> <br />BACKGROUND <br /> <br />The North Metro Telecommunications Commission approved recommended updates to the <br />organization’s Joint Powers Agreement at their April 15, 20 20 meeting. <br /> <br />Recommended changes include: <br /> Removing references to two budgets (the Commission/NMTV has had one budget for <br />the last twelve years); <br /> Removing the requirement that a city joining the Commission must be contiguous to a <br />current member city; <br /> Rephrasing quorum requirements that maintain the status quo, but would not require <br />additional changes should cities join the Commission; <br /> Removing reporting and oversight language no longer applicable due to law/rule <br />changes; <br /> Including PEG fees as fees available for payments for bonds. <br /> <br />These changes would give the Commission and cities more control over who could join the <br />Commission and over how franchise and PEG fees are spent. <br /> <br />Any changes to the Joint Powers Agreement will require approval of the member city councils. <br /> <br />The Commission recommends that the Member Cities approve the updates to the organization’s <br />Joint Powers Agreement. <br /> <br />RECOMMENDATION <br /> <br />Adopt Resolution No. 20-38, Amending Joint Cooperative Agreement. <br /> <br />ATTACHMENTS <br /> <br />Resolution No. 20-38 <br />Amended and Restated Joint Cooperative Agreement (including revisions)
