Nadeau Acres <br />Development Agreement <br />August 10, 2020 <br /> page 13 <br />24. Land Use Controls <br /> <br />a. Nadeau Acres is approved by the City Council by Ordinance No. 02-20, <br />Resolution No. 20-20 and Resolution No. 20-83. <br /> <br />b. Per Resolution No. 20-83 approving the final plat, the following conditions <br />apply: <br /> <br />i. Outlots A, B, C, D and E shall be deeded to the City. <br />ii. A temporary cul de sac easement shall be recorded over the west end of <br />William Lane upon development of that phase. <br />iii. The temporary cul de sac shall be removed, ground restored and the <br />temporary easement released upon extension of William Lane. <br />iv. The private septic system at 6677 20th Avenue shall be removed. <br />v. The private well at 6677 20th Avenue shall be capped. <br />vi. The private septic system 6651 20th Avenue shall be removed upon <br />development of that phase. <br />vii. The existing house at 6651 20th Avenue shall hook up to municipal <br />sanitary sewer upon development. <br />viii. The existing south driveway of 6709 20th Avenue shall be relocated west <br />onto Red Oak Lane. <br />ix. The existing driveway at 6677 20th Avenue shall be removed in Phase 1 <br />of development. <br />x. The existing driveway at 6651 20th Avenue shall be removed in Phase 2 <br />of development. <br />xi. A building permit is required for the house relocation at 6677 20th <br />Avenue. <br />xii. The stormwater maintenance for public facilities including the Vickers <br />Permanent Drainage & Utility Easement will be covered under the City’s <br />Programmatic Stormwater Management Agreement. <br /> <br />
