<br /> <br /> <br /> <br />This agreement is made this 26th day of August, 2020, pursuant to Minnesota Statute §471.59 by and <br />between the City of Lino Lakes (City) and Independent School District #12 (School District). <br /> <br />1. PURPOSE The City of Lino Lakes and the Centennial School District wish to participate <br />in a YouthSchool Resource Officer Program. Both the City and the School District agree <br />that a more formalized approach to the YouthSchool Resource Officer Program is needed <br />to improve understanding and promote mutual respect between police, school, staff, <br />counselors, parents and students. The purpose of this Agreement is to set forth in writing <br />the terms and conditions of the mutual duties and obligations and to create, fund and <br />implement the position of YouthSchool Resource Officer. <br /> <br />2. FUNDING The School District will fund the following expenses in connection with the <br />YouthSchool Resource Officer: <br />Officer's salary and related benefits are estimated at $91,305.14 for the 2020-21 <br />school year. This expenditure shall be determined by the number of hours assigned <br />to the school district. The hourly rate for 2020-21 shall be $66.36. The School <br />District officials and Lino Lakes Police Chief shall determine the specific <br />days/hours of work. <br /> <br />3. SERVICES The City shall provide the services of one licensed police officer and related <br />support services and supplies to assist the School District in establishing a YouthSchool <br />Resource Officer Program. The Officer will have primary responsibility in serving as a <br />resource person to faculty, classroom members and school administrators in the promoting <br />of positive juvenile behavior. The School District agrees to provide adequate office space, <br />telephone and other reasonable clerical support services. This officer will not act as an <br />education or related service provider under the Individuals with Disabilities Education Act <br />or related state law for any student. <br /> <br />4. PAYMENT The City shall provide billing to the School District for services provided in <br />this Agreement on a quarterly basis. <br /> <br />5. TERM This Agreement shall commence on the 26th day of August, 2020, and shall end <br />on/or about June 9, 2020. Thereafter, it shall be renewed on a yearly basis by mutual <br />agreement. This Agreement may be canceled by either party by a 30 day written notice. <br /> <br />6. GENERAL PROVISIONS it is expressly agreed that the YouthSchool Resource Officer <br />is a City employee and shall not be considered an employee of the School District for any <br />purpose including but not limited to salaries, wages, other compensations or fringe benefits, <br />Workers Compensation, Unemployment Compensation, P.E.R.A, Social Security, <br />Liability Insurance, keeping of personnel records, termination of employment, individual <br />contracts or other contractual rights. The City shall assume all liability for the actions taken <br />by the Officer in the performance of his/her duty as a Peace Officer.
