Rosemary Way street right-of-way extends to the west lot line on the <br />preliminary plat in order to provide future transportation and utility connection <br />to the west. <br />c. Any future phase final plat submittal that shows the Rosemary Way street right- <br />of-way shifting north or south shall not be deemed inconsistent with the <br />preliminary plat provided that such location is approved by the City. <br />d. Municipal utilities shall be extended to the west property line. Future platting of <br />Outlot B, Belland Farms shall require street construction to the west lot line. <br />e. Future development to the north of Rosemary Way will require sidewalk <br />construction on the north side of the street. <br />f. Outlot A contains a publicly maintained stormwater pond. The outlot shall be <br />deeded to the City after the stormwater pond improvements, vegetation, and <br />landscaping have been installed, established and accepted by the City. <br />g. Future development of Outlot B may require a traffic study to evaluate impacts <br />to 24th Avenue, Rosemary Way, CSAH 14/Main Street and Otter Lake Road. <br />h. A Permanent Trail easement and exhibit shall be recorded over the trail on Lot <br />1, Block 1, Belland Farms. <br />i. The developer is responsible for the installation of the trail. <br />j. The City is responsible for long term maintenance of the trail. <br />k. The City will reimburse the Developer the costs of the trail construction. <br />I. The final plat and development agreement shall be recorded prior to any <br />conveyances by Developer to a third party. <br />20. Hours of Construction Activity. <br />All construction activity shall be limited to the hours as follows: <br />Monday through Friday 7:00 a.m. to 7:00 p.m. <br />Saturday 9:00 a.m. to 5:00 p.m. <br />Sunday and Holidays No working hours allowed <br />21. Insurance. Developer or its general contractor shall take out and maintain until one <br />year after the City accepts the Developer Improvements, public liability and property <br />damage insurance covering personal injury, including death, and claims for property <br />damage which may arise out of the Developer's or general contractor's work, as the <br />case may be, or the work of its subcontractors or by one directly or indirectly employed <br />by any of them. Limits for bodily injury and death shall be not less than Five Hundred <br />Thousand and no/100 ($500,000.00) Dollars for one person and Two Million and no/100 <br />($2,000,000.00) Dollars for each occurrence; limits for property damage shall be not less <br />than One Million and no/100 ($1,000,000.00) Dollars for each occurrence; or a <br />combination single limit policy of Two Million and no/100 ($2,000,000.00) Dollars or <br />more. The City, its employees, its agents and assigns shall be named as an additional <br />insured on the policy, and the Developer or its general contractor shall file with the City <br />a certificate evidencing coverage prior to the City signing the plat.
