Natures Refuge <br />Development Agreement <br />January 24, 2022 <br />24. Land Use Controls - Planned Unit Development <br />a. Natures Refuge is a Planned Unit Development (PUD) as approved by the City <br />Council by Ordinance No. 05-18, Resolution No. 18-70, Resolution No. 20-81 and <br />Resolution No. 22-13. <br />b. Per Resolution No. 22-13 approving the PUD Final Plan/Final Plat, the following <br />conditions apply: <br />i. Outlot A shall be owned and maintained by Preferred Properties and <br />Management, LLC. <br />ii. Outlots B thru F shall be owned and maintained by the Natures Refuge <br />Homeowners Association (HOA). <br />1. The developer is responsible for the installation and <br />establishment of landscaping and fences. <br />2. The HOA is responsible for the long term maintenance of <br />landscaping and fences except for boulevard trees. <br />3. The City shall install and maintain boulevard trees. <br />iii. Outlot G shall be deeded to 801 Main Street and the two (2) parcels shall <br />be combined. <br />iv. Outlots A, B and D are protected by a recorded Conservation Easement <br />and WMC Buffer Declaration. <br />1. The developer or property owner is responsible for the <br />installation and establishment of landscaping and vegetation per <br />Attachment B of the Declaration. <br />2. The City shall inspect and accept such landscaping and vegetation. <br />3. The HOA or property owner is responsible for the long term <br />maintenance of the landscaping, vegetation and wetland <br />monument signs. <br />v. Surface Water and Stormwater Management is as follows: <br />1. Pond 100, Pond 400, Infiltration Basin 10 and Infiltration Basin 20 <br />will be maintained by the City per the City's Programmatic <br />Stormwater Management Facility Maintenance Agreement with <br />RCWD. <br />2. ACID 10-22-32 channel crossing/culvert will be maintained by the <br />City per the Maintenance Agreement -Channel Crossing. <br />3. Lake 200 and Lake 300 will be maintained by the HOA per the <br />Declaration for Maintenance of Stormwater Facilities. <br />4. RCWD will continue to maintain ACID 10-22-32 <br />vi. A Permanent Trail Easement and exhibit shall be recorded over the trail <br />corridor after the trail has been constructed. <br />1. The developer is responsible for the installation of the trail. <br />2. The City is responsible for long term maintenance of the trail. <br />3. The HOA shall allow for the construction of the trail on their <br />property. <br />page 15 <br />
