NorthPointe 8tn Addition <br />Development Agreement <br />February 14, 2022 <br />If a portion, section, subsection, sentence, clause, paragraph or phrase in this <br />agreement is for any reason held to be invalid by a court of competent <br />jurisdiction, such decision shall not affect or void any of the other provisions of <br />the Development Agreement. <br />c. Land Use Controls - Planned Unit Development. <br />NorthPointe, which includes the Subdivision, is a Planned Unit Development (PUD) as <br />approved by the City Council by Ordinance No. 02-14 and Resolution No. 14-21. <br />a. The existing conservation easement and wetland buffer declaration may be <br />amended with approval from RCWD. <br />b. A Development Agreement and securities related to the final plat are required. <br />c. A Declaration for Maintenance of Stormwater Facilities related to the private <br />stormwater management facilities is required. <br />d. A temporary cul-de-sac easement and exhibit are required over the cul-de-sac. <br />e. Separate sign permit applications are required for all permanent <br />monument/pylon and wall signage. <br />page 12 <br />
