CITY COUNCIL <br />AGENDA ITEM 1H <br />STAFF ORIGINATOR: Sarah Cotton, City Administrator <br />MEETING DATE: February 14, 2022 <br />TOPIC: Consider Approval of Settlement Agreement, St. Clair Land <br />Company <br />VOTE REQUIRED: 3/5 <br />INTRODUCTION <br />The Council is being asked to approve a Settlement Agreement and Release between St. Clair <br />Land Company and the City of Lino Lakes. <br />BACKGROUND <br />The City of Lino Lakes and St. Clair Land Company are parties to a civil action captioned St. <br />Clair Land Company v. City of Lino Lakes, Anoka County Court File No. 02-CV-20-4137, <br />relating to St. Clair's breach of contract claims against the City. A court trial was held on <br />October 4 and 5, 2021, and the Court issued Findings of Fact, Conclusions of Law and Order <br />for Judgment on February 3, 2022. The Parties wish to resolve all Claims between them in the <br />Full and Final Settlement Agreement and Release (attached). <br />RECOMMENDATION <br />Staff is recommending approval of the Settlement Agreement and Release. <br />ATTACHMENTS <br />Final Settlement Agreement and Release <br />
