Streets and Alleys <br />A private road from Otter Lake Road extends west across the north boundary of Lot 1, <br />Block 1. The private road is proposed within Outlot D. Outlot D shall be incorporated <br />into Outlot A and a private road easement agreement or Operating, Easements and <br />Maintenance Agreement (OEM) recorded over it. This will avoid any issues with future <br />ownership and maintenance responsibilities of the private road. The developer is <br />proposing to record an OEM after ownership of the outlots is transferred; however, staff <br />has concerns regarding future ownership of the outlot. <br />No public street improvements are required except for a southbound right turn lane from <br />Otter Lake Road onto CSAH 14 (Main Street). <br />The private road is proposed at 28ft wide back to back. To be consistent with Main Street <br />Shoppes, it shall be revised to 30ft. <br />An additional 60 ft of road right-of-way is being dedicated along Otter Lake Road except <br />for a 35 ft wide strip that was acquired by the City in 2013 for the purpose of constructing <br />Otter Lake Road. <br />Similar to Main Street Shoppes, a Declaration of Access Control will be required. The <br />Declaration shall state the private access road to the development will have full access to <br />Otter Lake Road upon completion, but such full access must be reduced to right -in, right - <br />out access upon further extension of the Otter Lake Road to the north. <br />Staff notes the private road shall extend north to serve future development and eventually <br />connect to the future full access at Otter Lake Road. The stormwater pond located at the <br />west end of the private road would require the future road extension to impact a wider <br />section of wetland. The developer may want to consider a redesign of the pond to allow <br />for future private road extension with less wetland impacts. <br />Easements <br />Standard drainage and utility easements at least 10 feet wide have been provided on Lot <br />1, Block 1 except for the west lot line. An easement shall be provided there. <br />A drainage and utility easement is required over the private road and the stormwater pond <br />facilities. <br />Previously recorded highway easements and utility easements along CSAH 14 (Main <br />Street) exist on site. <br />Public Land Dedication <br />The City will collect a cash fee of $3,603 minus trail construction credits in lieu of land <br />dedication for commercial development for Lot 1, Block 1, Otter Crossing.
