I have reviewed the decisions that Mr. Peskar cited in his letter. It would <br /> be my opinion that the cases kited by Mr. P'eskar would uphold the position that <br /> such a charter amendment would be considered illegal. It appears from reading <br /> these decisions and the statute that the Minnesota legislature may well have pre- <br /> empted any local deviation from the state statute. <br /> I therefore would not recommend that the City Charter Commission adopt such a <br /> regulation and that it continue to rely on the provisions found in the state statute <br /> which require a two-thirds vote of the council for any zoning change. <br /> If you have any further questions, please contact me. <br /> Sincerely, <br /> William G.
