STAFF ORIGINATOR: <br />P & Z MEETING DATE: <br />REQUEST: <br />CASE NUMBER: <br />APPLICANTS: <br />OWNERS: <br />BACKGROUND <br />PLANNING & ZONING BOARD <br />AGENDA ITEM 8A <br />Katie Larsen, City Planner <br />May 11, 2022 <br />Zoning Ordinance Update (Home Occupation Permits) <br />N/A <br />City of Lino Lakes <br />Multiple <br />As part of the zoning ordinance update, staff would like to discuss with the Planning & Zoning <br />Board the City's current ordinance regarding Home Occupation Permits. Specifically, the Level <br />C permits. <br />ANALYSIS <br />In the current zoning ordinance, Section 1007.047 regulates home occupation. In general, the <br />section categorizes home occupations into three (3) levels based on the intensity of the home <br />occupation and land use. <br />Level A: This is the least intense land use. No customers or employees are allowed on site. No <br />home occupation is allowed in accessory structure. Minimal disturbance. No permits are <br />required. An example could be an insurance agent, online sales, etc. <br />Level B: This is a slightly higher intense land use. Two (2) customers or employees are allowed <br />on site. Limits vehicle trips and deliveries. Home occupation is allowed in accessory structure. <br />A one-time home occupation permit is required. An example could be a hair salon, at home <br />baker, etc. <br />Level C: This is the most intense land use. Five (5) customers or employees are allowed on site. <br />More vehicle trips and deliveries are allowed. A conditional use permit is required. An example <br />could be a small landscaping business or contractor's shop. <br />Staff has been evaluating the Level C section of the ordinance. Currently, there are several rural <br />and residential properties in the City that appear to be operating unpermitted businesses that <br />would not meet the Level C home occupation requirements. Code enforcement on these <br />properties is difficult and overtime, the business and intensity have a tendency to grow. <br />
