Anoka County Highway Department <br />Per the County's October 7, 2021 letter, they have reviewed the preliminary plat and final plat <br />and have no further comments. <br />MNDNR Comments <br />MNDNR provided email comments on October 6, 2021. They request the OHWL elevation <br />(NAVD 88) shown on the preliminary plat be revised to reflect the DNR's official complete <br />value which is 908.36. This revision has been made. <br />VLAWMO Comments <br />VLAWMO provided advisory comments on August 31, 2021 and September 27, 2021. <br />Overall, the development's stormwater plan meets rate control, runoff volume and water <br />quality requirements. Wetland boundaries, management classifications and buffer widths have <br />also been reviewed and approved. <br />Development Agreement <br />A Development Agreement has been drafted by the City and shall be executed. <br />Title Commitment <br />Per the City Attorney and as detailed in Resolution No. 21-114 approving the preliminary plat, <br />the following comments regarding the title commitment and final plat shall be addressed prior <br />to final plat approval: <br />1. The effective date shall be updated. The title commitment has been updated. <br />2. Item 15(a) in Schedule B-Part II indicates a gap exists between the road right-of-way <br />and the property line. On June 14, 2022, an Order for Judgement was made by the <br />District Court resolving the gap in title issue. <br />3. These items shall be resolved prior to Council approval. These issues have been <br />resolved_ <br />Stormwater Maintenance Agreement <br />The stormwater ponds will be privately maintained and a Stormwater Maintenance Declaration <br />will be r-equir-e have been drafted with the final plat and shall be recorded by the applicant. <br />Findings of Fact <br />The Findings of Fact for Lake Amelia Woods are detailed in Resolution No. 22-18. <br />RECOMMENDATION <br />Staff and Boards recommend approval of the attached resolutions for Lake Amelia Woods <br />Final Plat and Development Agreement. <br />II <br />
