Citv Shoreland Ordinance <br />Both lots are located within the Shoreland Management Overlay district of Rice Lake which is <br />classified as a natural environment lake. The purpose of requiring the two (2) substandard lots <br />to be combined is to create one (1) parcel that is more in compliance with minimum lot size and <br />lot width requirements. <br />• Per City Code Chapter 1102: Shoreland Management Overlay: <br />o Section 1102.07 Zoning and Water Supply/Sanitary Provisions. <br />(1) Lot area and width standards. <br />(a) Residential Zoning Districts <br />a. Lot Area per Unit: Unsewered lot on a Natural Environment Lake is 10 <br />acres <br />b. Lot Width: Unsewered lot on a Natural Environment Lake is 330ft. <br />o Section 1102.08 Nonconformities. <br />(1) Construction on nonconforming lots of record. <br />(c) If, in a group of two or more contiguous lots under the same ownership, any <br />individual lot does not meet the requirements of § 1102.07(1), the lot must not be <br />considered as a separate parcel of land for the purposes of sale or development. The lot <br />must be combined with the one or more contiguous lots so they equal one or more <br />parcels of land, each meeting the requirements of § 1102.07 of this chapter as much as <br />possible. <br />Minnesota State Statute <br />• Per Minnesota State Statute 462.357 Subd.le. Nonconformities related to shoreland lots: <br />(f) In a group of two or more contiguous lots of record under a common ownership, an <br />individual lot must be considered as a separate parcel of land for the purpose of sale or <br />development, if it meets the following requirements: <br />(1) the lot must be at least 66 percent of the dimensional standard for lot width and lot <br />size for the shoreland classification consistent with Minnesota Rules, chapter 6120; <br />(2) the lot must be connected to a public sewer, if available, or must be suitable for the <br />installation of a Type 1 sewage treatment system consistent with Minnesota Rules, chapter <br />7080, and local government controls; <br />(3) impervious surface coverage must not exceed 25 percent of each lot; and <br />(4) development of the lot must be consistent with an adopted comprehensive plan. <br />(g) A lot subject to paragraph (f) not meeting the requirements of paragraph (f) must be <br />combined with the one or more contiguous lots so they equal one or more conforming lots as <br />much as possible. <br />
