(d <br /> 4-1 <br /> CITY OF LINO LAKES <br /> RESOLUTION NO. 22-87 <br /> RESOLUTION APPROVING CONDITIONAL USE PERMIT FOR EARTH <br /> MOVING AND STOCKPILING AT REHBEIN SITE DEVELOPMENT PREP <br /> (PIDS #24-31-22-24-0002 AND #24-31-22-24-0009) <br /> WHEREAS, the City received a land use application for a Conditional Use Permit for <br /> earth moving and stockpiling on properties on 2 1"Avenue South and hereafter referred <br /> to as "Development"; and <br /> WHEREAS, the properties are zoned GB, General Business, and allow for earth <br /> removal, land reclamation, material storage or filling with a conditional use permit; and <br /> WHEREAS, the legal descriptions of the subject properties are as follows: <br /> Outlot A, CLEARWATER CREEK BUSINESS CENTER, Anoka County, Minnesota; <br /> and, <br /> That part of the Southeast Quarter of the Northwest Quarter(SE 1/4 of NW 1/4) of Section <br /> 24, Township 31, Range 22, described as follows, to-wit: Commencing at the Southwest <br /> corner of said Southeast Quarter of Northwest Quarter (SE 1/4 of NW 1/4) of Section 24, <br /> thence running East along the South line of said Southeast Quarter of Northwest Quarter <br /> (SE 1/4 of NW 1/4) a distance of 275 feet; thence running North parallel with the West line <br /> of said Southeast Quarter of Northwest Quarter (SE 1/4 of NW 1/4) a distance of 375 feet; <br /> thence West parallel with the South line of said Southeast Quarter of Northwest Quarter <br /> (SW 1/4 of NW 1/4) a distance of 275 feet to the West line of said Southeast Quarter of <br /> Northwest Quarter(SE %4 of NW 1/4); thence running South along the West line of said <br /> Southeast Quarter of Northwest Quarter(SE 1/4 of NW 1/4) a distance of 375 feet to the <br /> point of beginning; Anoka County, Minnesota. <br /> WHEREAS, City staff has completed a review of the land use application based on the <br /> plan set prepared by Ryan A+E, Inc. dated July 11, 2022, and received by the City on <br /> July 12, 2022. <br /> WHEREAS, a public hearing was held before the Planning &Zoning Board on August <br /> 10, 2022, and the Board recommended approval of the conditional use permit. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lino <br /> Lakes hereby makes the following findings: <br /> FINDINGS OF FACT <br /> 1.
