CITY COUNCIL <br />AGENDA ITEM 1F <br />STAFF ORIGINATOR: Lisa Hogstad-Osterhues, Deputy City Clerk <br />MEETING DATE: September 12, 2022 <br />TOPIC: Consider Approval of Resolution No. 22-107, Application <br />for Temporary On-Sale Liquor License and Exempt <br />Gambling Permit for and for Lino Lakes Lions Club <br />VOTE REQUIRED: 3/5 <br />INTRODUCTION <br />The Lino Lakes Lions Club is planning the annual fundraising Prime Rib Dinner to be held on <br />Saturday, October 8, 2022 at St. Joseph of the Lakes Catholic Church, 171 Elm Street. <br />BACKGROUND <br />The Lions Club is requesting approval of a 1 to 4 Day Temporary On-Sale Liquor License, <br />which is necessary to allow the group to mix and dispense liquor that will be served as part of the <br />dinner. <br />In addition, they are requesting approval of a LG220 Exempt Gambling Permit for a raffle. Non- <br />profit organizations are allowed, under the State Gambling Statutes, to apply for an exemption <br />from a gambling license if they conduct five (5) or fewer gambling occasions per calendar year. <br />The Lino Lakes Lions Club conducts five (5) or less per calendar and, therefore, remains exempt <br />from requiring a gambling license. <br />Minnesota Statutes, Chapter 349, Section 349.166, Subd. 2 does, however, require that the non- <br />profit organizations applying for the exemption permit, notify the city that they are applying for <br />the exemption and receive local approval. <br />Staff has determined that the Lino Lakes Lions Club is eligible for the licenses under city <br />regulations. The Public Safety Department has conducted the required background check on the <br />applicant within the past year and have found no reason to deny. <br />A copy of the application and a copy of the certificate of liquor liability insurance are on file in <br />the city clerk's office. <br />RECOMMENDATION <br />Approve Resolution No. 22-107, approving a 1 to 4 Day Temporary On-Sale liquor license and <br />LG220 Exempt Gambling Permit with no waiting period.
