CITY COUNCIL <br />AGENDA ITEM 3A <br />STAFF ORIGINATOR: Meg Sawyer, Human Resources and Communications Manager <br />MEETING DATE: September 12, 2022 <br />TOPIC: Consider Approval of Resolution 22-104, Drug and Alcohol <br />Testing and Drug -Free Workplace Act Policy for Non -DOT <br />Update <br />VOTE REQUIRED: 3/5 <br />INTRODUCTION <br />The Council is being asked to consider Resolution No. 22-104, which updates the Drug and <br />Alcohol Testing and Drug -Free Workplace Act Policy for Non -DOT employees. <br />BACKGROUND <br />Staff is seeking council approval on the updated the Drug and Alcohol Testing and Drug -Free <br />Workplace Act Policy for Non -DOT employees. <br />The new Minnesota law has legalized cannabinoids which would require the City to update its <br />policy. The policy would use the term "drug" as opposed to "controlled substance" to capture <br />cannabinoids, which are consumed legally, but whose use would still violate this policy. <br />It would add language to the drug and alcohol section which would include references to <br />edibles or beverages containing cannabinoids and would note the fact that cannabinoids may be <br />lawfully purchased and consumed, in some circumstances, but would not permit anyone to use, <br />possess, or be impaired by in the workplace. <br />Staff has reviewed and updated the Non -DOT policy to be reflective of any changes within law <br />and best practices. <br />RECOMMENDATION <br />Staff recommends approval of Resolution No. 22-104 <br />ATTACHMENTS <br />Resolution No. 22-104 <br />Drug and Alcohol Testing and Drug -Free Workplace Act Policy for Non -DOT <br />
