CITY OF LINO LAKES <br /> RESOLUTION NO. 22-100 <br /> RESOLUTION APPROVING NEW HORIZON ACADEMY <br /> PARKING DEFERMENT AGREEMENT <br /> WHEREAS,the City Council approved a conditional use permit for a commercial day care <br /> facility for New Horizon Academy with Resolution No. 22-98 on September 12, 2022; and <br /> WHEREAS, the legal description of the property will be Lot 1, Block 1, Belland Farms Second <br /> Addition after recording of the final plat; and <br /> WHEREAS, per the City Code Section 1007.044, Off-Street Parking, a day care facility requires <br /> one (1) space per teacher on the largest shift, plus one (1) space per five (5) students/children <br /> based on the maximum capacity of the facility. The proposed day care facility requires 60 total <br /> spaces; and <br /> WHEREAS,New Horizon Academy requested a reduction in the number of required parking <br /> stalls pursuant to the parking deferment provisions of City Code Section 1007.044 (7); and <br /> WHEREAS, the City agrees to reduce the number of required stalls provided all requirements of <br /> City Code Section 1007.044(7) are, and remain, satisfied. <br /> n NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes <br /> hereby approves the Parking Deferment Agreement between New Horizon Real Estate <br /> Development 6, LLP and the City of Lino Lakes and authorizes the Mayor and City Clerk to <br /> execute such agreement on behalf of the City. <br /> Adopted by the Council of the City of Lino Lakes this 12t" day of September, 2022. <br /> The motion for the adoption of the foregoing resolution was introduced by Councilmember <br /> Lyden and was duly seconded by Councilmember Cavegn and upon vote being taken thereon, <br /> the following voted in favor thereof.
