CITY OF LINO LAKES <br /> RESOLUTION NO. 22-125 <br /> RESOLUTION APPROVING THE RECORD OF DECISION AND MAKING A <br /> NEGATIVE DECLARATION ON THE NEED FOR AN ENVIRONMENTAL IMPACT <br /> STATEMENT FOR THE ROBINSON SOD FARM <br /> WHEREAS,MN Rules 4410 establishes the requirements for the preparation of an <br /> Environmental Assessment Worksheet(EAW); and <br /> WHEREAS,the City initiated an environmental review to determine if the proposed Robinson <br /> Sod Farm development has the potential for significant environmental effects, as required by MN <br /> Rules, Chapter 4410.4300, Subpart 14; <br /> NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Lino Lakes finds <br /> that: <br /> 1. The EAW was prepared in compliance with the procedures of the Minnesota <br /> Environmental Policy Act and the Minnesota Rules, Parts 4410.1000 to 4410.1700 <br /> (2015); <br /> 2. The EAW satisfactorily addressed the issues for which existing information could have <br /> been reasonably obtained; <br /> 3. The City has reviewed comments on the EAW and has prepared responses to these <br /> comments, included in the Response to Comments, Findings of Fact and Record of <br /> Decision document, dated October 7, 2022, and made a part hereof; <br /> 4. Based on the criteria established in Minnesota Rules 4410.1700,the project does not have <br /> the potential for significant environmental effects; <br /> 5. The City makes a"Negative Declaration", and <br /> 6. An EIS is not required. <br /> Adopted by the City Council of the City of Lino Lakes this 1 Oth day of October, 2022. <br /> The motion for the adoption of the foregoing resolution was introduced by Councilmember <br /> Stoesz and was duly seconded by CouncilmemberRuhland and upon vote being taken thereon, <br /> the following voted in favor thereof.
