CITY OF LINO LAKES <br />RESOLUTION NO. 22-116 <br /> <br />RESOLUTION APPROVING SITE IMPROVEMENT PERFORMANCE AGREEMENT <br />WITH JAVA LINO RETAIL, LLC <br /> <br /> <br />WHEREAS, the City has completed review of the site and building plans for 601 Apollo Drive <br />Retail; and <br /> <br />WHEREAS, the legal description of the property is Lot 2, Block 1, Market Place 2nd Addition <br />after recording of the final plat; and <br /> <br />WHEREAS, City Code Section 1007.020(5)(d) requires the execution of a site performance <br />agreement prior to issuance of a building permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes that <br />the Site Improvement Performance Agreement between the City of Lino Lakes and Java Lino <br />Retail, LLC is hereby approved and the Mayor and City Clerk are authorized to execute such <br />agreements on behalf of the City. <br /> <br />Adopted by the Council of the City of Lino Lakes this 10th day of October, 2022. <br /> <br />The motion for the adoption of the foregoing resolution was introduced by Council <br />Member_______________ and was duly seconded by Council Member ________________ and <br />upon vote being taken thereon, the following voted in favor thereof: <br /> <br />The following voted against same: <br /> <br /> <br /> <br /> <br />_______________________________ <br />Rob Rafferty, Mayor <br /> <br />ATTEST: <br /> <br />________________________ <br />Julianne Bartell, City Clerk <br /> <br />
