<br />15 <br /> <br />and design will be subject to review and approval by the City Engineer, consistent with <br />City requirements, as part of the rezoning and preliminary plat review. <br />Comment 7. Did the City of Lino Lakes or Alliant Engineering initiate a study to determine if <br />“Quiet Enjoyment of Life” would be impacted or violated by the proposed street connection? <br />Response: No. There is no established City requirement or standard related to “Quiet <br />Enjoyment of Life”. The proposed development is subject to to existing City Code <br />requirements. The residential use of the site will be required to adhere to the city’s <br />noise ordinances. After construction, noise levels are expected to be at or near existing <br />levels. <br />Comment 8. Did the City of Lino Lakes or Alliant Engineering consult Anoka County to <br />determine property value losses if the cul-de-sac is removed? <br />Response: A property value study is not part of the environmental assessment review. <br />Comment 9. Does Anoka County plan to reassess property value losses and adjust home values <br />and taxes accordingly if Carl Street is connected. <br />Response: Anoka County assesses property on a regular basis, regardless of <br />development. There is no information that suggests a loss in property value. <br />Comment 10. Did the City of Lino Lakes or Alliant Engineering consult with Rice Creek <br />Watershed District on the disruption to the waterways, ditches, and wetlands within the impact <br />area? <br />Response: Yes, the developer has hired a consultant to conduct the wetland delineation <br />and wetland impact permit application of the site per the Wetland Conservation Act, <br />Section 404 of the Clean Water Act regulations. Rice Creek Watershed District is the <br />Local Government Unit that administers the Wetland Conservation Act and has been <br />working closely with the consultant on reviewing any waterway, ditch, and wetland <br />impacts from the proposed development. The wetland delineation report and permit <br />application will need to be formally reviewed and approved by Rice Creek Watershed <br />District, the Board of Soil and Water Resources, the U.S. Army Corps of Engineers and <br />any other regulatory authority on the Technical Evaluation Panel. <br />Comment 11. Many pedestrians, dog walkers, and bicyclists use the path at the end of the cul- <br />de-sac because they feel safe on Carl Street. Children cannot bike or walk on Lilac or 4th St <br />because they both are busy with traffic speeds far over the posted limits. Has this been taken <br />into consideration and are the proposed traffic areas in compliance with the Local Road <br />Research Board (LRRB)? <br />Response: Any proposed improvements to Carl Street would include off-street <br />pedestrian facilities. This would be evaluated as part of future land use approvals. The <br />Local Road Research Board does not establish transportation engineering standards. <br />Comment 12. How will the ACD-10-22 main trunk and BR2 be preserved and protected?
