CITY COUNCIL <br />AGENDA ITEM 4A <br /> <br /> <br />STAFF ORIGINATOR: John Swenson, Public Safety Director <br /> <br />MEETING DATE: October 24, 2022 <br /> <br />TOPIC: Consider 2nd Reading of Ordinance No. 03-22, Enacting Ordinance <br />Regulating Edible Cannabinoid Products <br /> <br />VOTE REQUIRED: 3/5 <br /> <br /> <br />INTRODUCTION <br /> <br />The City Council is being asked to consider the 2nd Reading of Ordinance No. 03-22, Enacting <br />Ordinance Regulating Edible Cannabinoid Products by adding a new Chapter 619 to the Lino <br />Lakes Code of Ordinances, entitled Edible Cannabinoid Products. <br /> <br />BACKGROUND <br /> <br />During the 2022 Minnesota Legislative Session, Minnesota Statute 151.72 was changed <br />regarding the sale of certain cannabinoid (CBD) products. This law took effect on July 1, 2022. <br /> <br />The new law amends the scope of sale of any product that contains cannabinoids extracted from <br />hemp and that is an edible cannabinoid product or is intended for human or animal consumption. <br /> <br />Previously adopted MN law authorized a product containing non-intoxicating cannabinoids to be <br />sold, but the authority to sell edible CBD products was unclear. The new law expands the <br />authority to include non-intoxicating cannabinoids, including edible cannabinoid products, <br />provided they do not contain more than 0.3% of any THC. An edible cannabinoid product also <br />cannot exceed more than five milligrams of any THC in a single serving, or more than a total of <br />50 milligrams of any THC per package. <br /> <br />Staff has researched the recently enacted MN Statute 151.72, reviewed ordinance enacted in <br />other Cities, participated in meetings and discussion through League of Minnesota Cities and <br />worked with City Attorney Jay Squires to develop this ordinance, staff is recommending that <br />Council add Ordinance 619 Regulating Edible Cannabinoid Products in the City of Lino Lakes. <br /> <br />The first reading of this ordinance took place on October 10, 2022. If approved, this ordinance <br />will be published for 30 days starting on November 1, 2022 and will be effective on December 1, <br />2022. <br /> <br />RECOMMENDATION <br /> <br />Staff recommends the adoption of Ordinance No. 03-22 with the following actions: <br /> <br />1. Dispense with the full reading of the ordinance; <br />2. Roll call vote for adoption of the ordinance. <br />
