<br />138 <br />§ 1007.046 PRIVATE STREETS. <br /> <br />(1) Purpose. The purpose of this section is to establish minimum requirements for private <br />streets in order to alleviate or prevent congestion of the public right-of-way and to promote the <br />safety and general welfare of the public. <br /> <br />(2) Requirements. In conjunction with the review of two family, townhouse, or multiple- <br />family residential plats, the City Council may approve private streets that serve more than one <br />dwelling unit if the following conditions are met. Private streets serving business, industrial, or <br />special district developments shall require a Planned Unit Development (PUD) in compliance <br />with City Code Section 1007.024. <br /> <br />(a) The City Council finds that the private street is deemed necessary to allow <br />reasonable development of a particular site, and that such private street is not allowed or <br />intended to be a substitute for the public street system. <br /> <br />(b) The private street shall not exceed 300 feet in length unless it forms a continuous <br />connection or loops back to a public street. A private street over 150 feet in length that does not <br />form a continuous connection or loop back to a public street shall provide a turn-around at or <br />near its terminus, in compliance with City General Specifications and Standard Detail Plates. <br /> <br />(c) The private street shall gain access only from streets classified as “local” or <br />“minor collector” by the City’s Comprehensive Plan. <br /> <br />(d) The private street shall gain access from the public street and shall maintain the <br />street drainage with concrete curb and gutter per City Standard Specifications for Construction. <br />Private street access on urban and rural streets shall have at a minimum a five (5) foot <br />bituminous or concrete apron. The remainder of the private street shall be designed, constructed <br />and surfaced as approved by the City Engineer. <br /> <br />(e) The private street shall be a minimum of 26 feet wide. No parking shall be <br />allowed on the private street, however, guest parking spaces may be required to be installed <br />adjacent to the private street, as determined by the City Council. <br /> <br />(f) Individual unit driveways that gain access from the private street shall be a <br />minimum of 25 feet in length. <br /> <br />(g) Approval of the private street shall not be granted if the private street is to be <br />located within a separate lot. <br /> <br />(h) Street signs shall be designed and installed in compliance with City General <br />Specifications and Standard Detail Plates. <br /> <br />(i) Signage stating “No Parking – Fire Lane” shall be located along the private street <br />in locations as approved by the City Fire Inspector.
