1st Reading: Publication: <br />2nd Reading: Effective: <br />CITY OF LINO LAKES <br />ORDINANCE NO. 05-22 <br />AMENDING CHAPTER 701 ENTITLED LIQUOR LICENSING BY ADDING <br />NEW SUBDIVISIONS RELATED TO COMPLIANCE CHECKS, VIOLATIONS AND <br />PENALTIES; DELETING CHAPTER 702 ENTITLED BEER LICENSING AND <br />INCORPORATING 3.2 PERCENT MALT LIQUOR INTO CHAPTER 701 <br />The City Council of Lino Lakes ordains: <br />Section 1. That Section 701.08 of the Lino Lakes Code of Ordinances be amended <br />to read as follows: <br /> 701.08 CONDITIONS OF THE LICENSE. <br />(1)General. Every license is subject to the conditions in the following divisions and all <br />other provisions of this chapter and of any other applicable ordinance, state law or regulation. <br />(2)Licensee responsibility. Every licensee shall be responsible for the conduct of his or <br />her place of business and the conditions of sobriety and order in it, including within any outdoor <br />serving area. The act of any employee on the licensed premises authorized to sell intoxicating <br />liquor there is deemed the act of the licensee as well, and the licensee shall be liable to all <br />penalties provided by ordinance, statute or regulation equally with the employee. <br />(3)Inspections. Every licensee shall allow any peace officer, health officer or properly <br />designated officer or employee of the city to enter, inspect and search the licensed premises <br />during business hours without a warrant. <br />(3) Display hours. No on-sale establishment shall display liquor to the public during <br />hours when the sale of liquor is prohibited. <br />(4)Federal stamps. No licensee shall possess a federal wholesale liquor dealers special <br />tax stamp or a federal gambling stamp. <br />(5) Minors on premises. No person under the age of 18 years shall be employed in any <br />rooms constituting the place in which liquors are sold at retail on-sale, except that persons under <br />the age of 18 may be employed as musicians or to perform the duties of a bus person, host or <br />dishwashing services in places defined as a restaurant, hotel, motel or other multi-purpose <br />building serving food in rooms in which liquors are sold at retail on-sale. <br />(6) Deliveries. No delivery of alcohol to an off-sale license may be made by a <br />wholesaler or accepted by an off-sale licensee on a Sunday. No order solicitation or <br />merchandising may be made by a wholesale on a Sunday.
