As defined in M.S. § 115.01, Subd. 22,103G.005, Subd. <br />17 means surface or underground waters, except surface waters that are not confined <br />but are spread and diffused over the land. Waters of the state includes boundary and <br />inland waters.means all streams, lakes, ponds, marshes, watercourses, waterways, <br />wells, springs, reservoirs, aquifers, irrigation systems, drainage systems, and all other <br />bodies or accumulations of water, surface or underground, natural or artificial, public or <br />private, which are contained within, flow through, or border upon the state or any portion <br />thereof. <br /> WETLAND. Land transitional between terrestrial and aquatic systems, as defined in <br />M.S. § 103G.005, Subd. 19. <br />(Ord. 09-15, passed 10-26-2015) <br /> <br /> <br />§ 1011.007 APPLICABILITY. <br /> All land land-disturbing activity may be subject to standard erosion and sediment <br />control BMPs. A grading, erosion and sediment control permit and/or a stormwater <br />management permit shall be required for projects that meet or exceed the thresholds <br />established in §§ 1011.009 010 and 1011.010011. <br />(Ord. 09-15, passed 10-26-2015) <br /> <br />§ 1011.008 EXEMPTIONS. <br /> The following land land-disturbing activities will be exempt from the grading, erosion <br />and sediment control and stormwater management permit requirements of this chapter: <br />(1) Cemetery graves; <br />(2) Routine agricultural activity such as tilling, planting, or harvesting of <br />agricultural, horticultural, or silvicultural (forestry) crops; and <br />(3) Emergency work necessary to protect life, limb, or property. <br />(Ord. 09-15, passed 10-26-2015) <br /> <br />§ 1011.009 TECHNICAL REFERENCES. <br /> The following documents shall be used for technical reference: <br /> (1) The Lino Lakes Surface Water Management Plan. <br /> (2) The Lino Lakes Engineering Design Details. <br /> (3) The Lino Lakes Standard City Specifications. <br /> (4) The Rice Creek Watershed District (RCWD) Rules.
