{00394852 3} 1 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />AGREEMENT FOR RECIPROCAL DRIVEWAY EASEMENT <br /> <br /> This AGREEMENT FOR RECIPROCAL DRIVEWAY EASEMENT (the “Agreement”) <br />is made this day of___________, 202__ (the “Effective Date”), by and between City of Lino <br />Lakes, a Minnesota municipal corporation (“City”), and Watermark Master Homeowners <br />Association, a Minnesota nonprofit corporation (“HOA”). City and HOA may be individually <br />referred to herein as a “party” or “Owner” or collectively as the “parties” or “Owners.” <br /> <br />RECITALS <br /> <br />A. City is the fee owner of real property in the City of Lino Lakes, Anoka County, Minnesota, <br />legally described as Outlot C, WATERMARK 4TH ADDITION, according to the recorded <br />Plat thereof (“City Parcel”). <br /> <br />B. HOA is the fee owner of real property in the City of Lino Lakes, Anoka County, Minnesota, <br />legally described as Lot 1, Block 3, WATERMARK 4TH ADDITION, according to the <br />recorded Plat thereof (“HOA Parcel”). City Parcel and HOA Parcel may be individually <br />referred to herein as a “Parcel” or collectively as the “Parcels.” <br /> <br />C. The Owners desire to share use of a driveway (the “Driveway”) that will be located upon <br />and serve portions of City Parcel and HOA Parcel in a location that is generally depicted <br />as the “Driveway Easement Area” on EXHIBIT A, attached hereto and incorporated <br />herein (the “Driveway Easement Area”). <br /> <br />D. The Owners desire to grant to each other rights of access for vehicular and pedestrian <br />ingress and egress over the Driveway Easement Area located on their respective parcels. <br /> <br />AGREEMENTS <br /> <br />NOW, THEREFORE, in consideration of the foregoing recitals, the mutual promises and <br />covenants set forth herein, and for other good and valuable consideration, the receipt and <br />sufficiency of which are hereby expressly acknowledged, the parties agree as follows: <br />
