<br /> ATTACHMENT 1-A <br /> <br />Attachment I-A <br /> <br />State of Minnesota <br />General Obligation Bond Financed <br />CERTIFICATION <br /> <br /> <br /> The undersigned hereby certifies as follows: <br /> <br /> This Certification is being submitted pursuant to the Waiver of Real Property Declaration <br />granted by Minnesota Management and Budget to Metropolitan Council for Municipal Publicly- <br />Owned Infrastructure Inflow/Infiltration projects or the portions thereof which lie entirely within <br />public road, street and highway rights-of-way and utility easements. <br /> <br /> The City of Lino Lakes certifies that Lino Lakes has read and will comply with the terms <br />and conditions of the Waiver of Real Property Declaration, a copy of which is attached to this <br />Certification and further, that the Governmental Program which is the subject of and described in <br />the Municipal Publicly-Owned Infrastructure Inflow/Infiltration Grant Agreement between the <br />City of Lino Lakes and Metropolitan Council qualifies for the Waiver of Real Property <br />Declaration. <br /> <br /> The undersigned owns fee title to property and/or permanent easement and/or other <br />easement which meets the requirements of this Agreement for wastewater collection purposes <br />and/or permit for pipe in City of Lino Lakes public right of way which meets the requirements of <br />this Agreement for wastewater collection purposes and a wastewater collection system within the <br />fee title, permanent easement, and/or the other easement and wastewater collection system being <br />located in Anoka County, Minnesota. The fee title property, permanent easement and/or other <br />easement and the wastewater collection system therein is referred to as “Restricted Property” and <br />is described in Exhibit A attached hereto by legal description, narrative description or <br />diagram. <br /> <br /> As the owner of the Restricted Property, the undersigned hereby acknowledges the <br />following restrictions and encumbrances with respect to the Restricted Property: <br /> <br />A. The Restricted Property is State bond financed property within the meaning of Minn. <br />Stat. § 16A.695 that exists as of the effective date of the grant agreement identified in <br />paragraph B below, is subject to the encumbrance created and requirements imposed <br />by such statutory provision, and cannot be sold, mortgaged, encumbered or otherwise <br />disposed of without the approval of the Commissioner of Minnesota Management and <br />Budget, or its successor, which approval must be evidenced by a written statement <br />signed by said commissioner and attached to the deed, mortgage, encumbrance or <br />instrument used to sell or otherwise dispose of the Restricted Property; and <br /> <br />B. The Restricted Property is subject to all of the terms, conditions, provisions, and <br />limitations contained in the G.O Grant agreement between Metropolitan Council and <br />the City of Lino Lakes. <br />
