2 <br />Watermark 5th Addition and Watermark 6th Addition are located within the current Utility <br />Staging Area 1A (2018-2025) and next Utility Staging Area 1B (2025-2030). <br />2. The proposed development must be master planned. Small, piecemeal developments do <br />not justify redefining the 10-year staging area, or five-year phase. <br />The entire Watermark development is a Planned Unit Development master plan. <br />3. The proposed, master planned project must provide discernable public values. <br />Council Resolution No. 16-51 approved the Watermark PUD Development Stage <br />Plan/Preliminary Plat and detailed discernable public values. <br />4. Adequate infrastructure must be available to support development. Appropriate analysis <br />will determine if adequate infrastructure is available and what utility extensions and <br />transportation improvements are required to support new development. <br />Adequate infrastructure is available to support the Development. Infrastructure needs <br />were analyzed with approval of the PUD Development Stage Plan. <br />5.There must be a commitment that the development will pay its proportionate share of <br />infrastructure improvement costs associated with development. <br />The Developer shall enter into a Development Agreement with the City committing to pay <br />its proportionate share of the infrastructure improvements; and <br />WHEREAS, the Development is found to meet the criteria to allow development to occur early <br />in a 10-year staging area; and <br />WHEREAS, the proposed Development is not considered premature and meets the performance <br />standards of the subdivision and zoning ordinance; and <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes: <br />FINDINGS OF FACT <br />1. The final plat substantially conforms to the approved preliminary plat subject to the <br />conditions listed below. <br />2. The City Attorney reviewed the status of title/property ownership related to the final plat <br />with conditions listed below. <br />3.A Development Agreement has been drafted and shall be executed. <br />4. Conditions attached to approval of the preliminary plat have been fulfilled or secured by <br />the Development Agreement. <br />5. All fees, charges and escrow related to the preliminary or final plat have been paid in full.
